I was told by his insurance company (USAA) that witnesses not listed on the police report could not be used, but his friend is not on the police report and they are waiting for her statement. NC State Highway Patrol responded to the scene and the driver was cited for failure to yield the right of way. The driver was apologetic and admitted several times around a number of people that he must have blanked out or was daydreaming from the frustration of the school bus. USAA is saying that they need to make sure that my daughter was not 1% at fault, meaning speeding perhaps. The officer estimated her speed at impact at around 40 mph and the speed limit is 55mph. She hit the drivers back tire of his Jeep Wrangler (small truck) causing him to rest in a small trench or ditch ion the side of the attempted driveway. The front passenger side above the front tire and the front by the headlight is damaged on her car. She tried to avoid him, protect her younger sister (13) and avoid veering to much left in fear of hitting the school bus. My girls were terrified when I arrived 15 minutes after the accident. USAA stated that she may have had time to instanly stop, but she tried everything that she could do. In my opinion, she should have never been put into that situation. USAA is saying that points of contact are off, but my insurance agent said that she hit the back tire because a Jeep Wrangler is only 5 ft long and he was not towing a boat or driving a common sized vehicle. Plus the driver admitted to pushing down on the accelerator when he realized what was happening. I just need to have someones advice on this matter before hiring a lawyer. Thank you.

My car caught on fire due to some electrical wiring, im fully comp, and have never claimed before. But sneaky as they are, they have told me that they do not cover electrical wiring faults, which has caused the fire. But the AA who towed my car in has catergorised it as fire damage. Surely they must cover the fire damage. I took it to a repair centre near me, and have asked them to have a quick check, and they also say its fire damage and what not, this has been procrastinated for so long by the insurance company, (claims company rather) that i can't remember what the repair centre has stated. Surely, fully comp covers something like this? THEIR engineers have said that there was no further damage to the rest of the car, but can i trust THEIR engineers? A full check up costs a lot, as they would have to take apart the car ( i believe? ) When i rang up the lady at the claims centre, she had no idea what case i was on, she literally said 'give me a moment to read up on your case' for me, thats a bit pathetic. While speaking on the phone with her not only was she rude, almost shouting at me (as i pressed on further ) . She told me she would send the company policy booklet to show that electrical wiring is not covered, and a letter stating the case was closed and in detail what the whole case is about. A week and a half has gone by (she said couple of days) This is the most annoying thing. She was rude, unhelpful, unwilling to help, and just taking the pee with the whole thing. I just find it sketchy that the letter has not been made, and no further actions or anything has happened (i have also opened another case about another incident - no info .. still) . I think they are just hoping i'd give this up as they are so unwilling to pay out. This is the reason I have insurance. Whats the point otherwise? Sorry for the long read. I have no idea what to do now, can i take it to a small claims court or talk to someone in the city council to further my case? Thanks

My car is a 1994 Lexus ES300 with 125,000+ miles on it. I'll explain a little more. I own a duplex which I rent out the top of while my husband and I live down stairs. We also give them about $60 in random cash when they ask for help. I provide the formula, diapers and wipes and she provides the food. Background: My wife left me and is filing for divorce. She took her car which is a marital asset that both of us own. She has since left the state to move in with a friend and I cannot get a hold of her as she will not return my calls. Update: Our current auto coverage is set to expire on 10/17. I have taken out coverage on myself through a different company, set to start on the 17th. As of the 17th she will be uninsured unless she takes out her own policy. Is is my responsibility to make sure she is still insured on my policy? She won't return my calls or the calls that my new agent has left for her so my hands are tied. I just want to make sure I'm not doing anything that may bite me later. I also don't want to have to foot the bill for her portion of the insurance given that she doesn't live with me anymore and doesn't even live in the same state. The tail end of my car began to slide out to the right and I was unable to correct this due to the terrible conditions of the road. I spun completely around and was facing directly into traffic in the fast lane. A car traveling in the fast lane (at a rate of speed unknown to me) hit me head on, totaling both cars. Its hard to be sure, but I am estimating that the time between initial loss of control and impact was around 10 - 15 seconds. There were no injuries. Gap insurance and warranty on car that was totaled?

I am not sure who is right on this one.... We bought a car in 12/11. We purchased gap insurance and an extended warranty at that time through the dealer. We decided to refinance the car through the credit union were we are members. The gap insurance was 1/2 the price we purchased at the dealer. The dealer and bank said that we should receive a refund.
